01These terms
These terms are an agreement between you and Bit Microsystems LLC, a company registered in Wyoming, USA (“we”, “us”), about the DNS Switcher app for iPhone and Android (“the app”). By installing or using the app you agree to them. If you do not agree, do not use the app.
02Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices that you own or control, as allowed by the rules of the store you downloaded it from. The app is licensed to you, not sold.
You may not:
- copy, resell, rent, sublicense or redistribute the app
- modify it, or reverse engineer it except where the law gives you that right
- remove or alter any copyright, trademark or other notice
03What the app does, and what it does not
The app changes which DNS resolver your phone uses, by means of a local, DNS-only VPN profile. It does not encrypt your DNS lookups or your traffic, does not hide your IP address and does not route your traffic through any server.
It is not a privacy, security, anonymity, parental-control or content-filtering product. Do not rely on it for any of those purposes.
04Acceptable use
You agree to use the app lawfully. In particular, you agree not to use it to:
- break any law or regulation that applies to you
- get around rules or restrictions that you are required to follow on a network you do not control, such as a workplace or school network
- interfere with, overload or attack any network, DNS server or service
- use a DNS server that you do not have permission to use
You are responsible for the servers you enter as custom DNS and for any mobile data charges from your carrier. When you use the app you must also follow any third-party terms that apply to you, such as your mobile carrier’s agreement and the terms of the DNS provider you choose.
05Third-party DNS providers
The DNS resolvers the app can point to (Cloudflare’s 1.1.1.1, Google Public DNS at 8.8.8.8, and any custom server you enter) are independent services operated by third parties under their own terms and privacy policies. We do not operate, control or endorse them, and we are not affiliated with them.
We are not responsible for their availability, speed, accuracy, filtering or logging, or for anything that results from using them. A provider may change or withdraw its service at any time.
06Updates are required
The app checks whether a newer version is available and only runs on its latest version. When a newer version is in the App Store or on Google Play, the app will ask you to update and cannot be used until you do. Updates are delivered only through the App Store and Google Play.
We may change, suspend or discontinue the app, or any part of it, at any time.
07Privacy
The app collects no personal data. The privacy policy explains what the app does on your phone and what your DNS provider sees.
08No warranty
The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.
We do not promise that the app will be uninterrupted or free of errors, that it will work on every device, network or operating-system version, or that DNS lookups will always reach the resolver you chose. Your phone, your network, another VPN or the DNS provider can each prevent that.
09Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, connectivity, revenue or profits, arising from your use of the app or from being unable to use it. Our total liability for any claim about the app is limited to the amount you paid for it in the twelve months before the claim, or ten US dollars, whichever is greater.
Some places do not allow some of these limits. Where that is the case, they apply only as far as the law permits, and nothing in these terms takes away rights that you have under consumer-protection law and cannot give up.
10Ending these terms
You can stop using the app at any time by deleting it, which also removes its VPN profile. Your licence ends automatically if you break these terms. The sections on warranty, liability and governing law continue to apply afterwards.
11App Store and Google Play
These terms are between you and us, not with Apple or Google. Your use of the app must also follow the terms of the store you downloaded it from.
If you downloaded the app from Apple’s App Store, the following also applies:
- The licence is limited to use on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- We, not Apple, are solely responsible for the app and its content, and Apple has no obligation to provide maintenance or support for it.
- If the app fails to conform to any warranty that applies despite the section above, you may notify Apple, and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for addressing any claims about the app, including product-liability claims, claims that it fails to meet a legal or regulatory requirement, consumer-protection or privacy claims, and claims that it infringes someone’s intellectual property.
- You confirm that you are not located in a country subject to a US Government embargo or designated by it as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12Governing law
These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute about them or about the app will be brought in the state or federal courts located in Wyoming, unless the consumer-protection law of the place where you live gives you the right to bring it elsewhere.
13General
If any part of these terms is found to be unenforceable, the rest stays in effect. If we do not enforce a term straight away, we have not given up the right to enforce it later. You may not transfer your rights under these terms to anyone else.
14Changes to these terms
We may update these terms. When we do, we will change the effective date at the top of this page. If you keep using the app after a change, you accept the updated terms.
